    Hello experts,

    we are currently working on a Server Virtualization project for a new small customer (less than 15 users). Our primary goal is to switch to a modern Data Protection and Backup solution built for Virtualization in order to simplify backup operations and ensure a reliable RTO and RPO.

    The customer is currently using a single physical instance of Windows Server 2008 R2 Standard Edition (OEM License) which came with a HP ProLiant ML370 G6 Server (a dual-socket system that uses modern Intel Xeon Quad-Core CPUs) the customer bought last year.

    As part of the Server Virtualization project, we are planning to repurpose the mentioned HP ProLiant ML370 G6 Server as a Standalone VMware ESXi host. We will be adding to it plenty of HP memory, a 512MB with BBWC upgrade to the existing HP Smart Array P410i/256 MB Controller and an additional set of HP 6G SAS 15K rpm high performance drives.

    With regard to the virtual machines, we will also be implementing Exchange On-Premises (so many areas in Italy still don't have fast/reliable enough broadband connections, so an hosted-only Exchange solution is currently not an option) so we will ideally have a VM running SBS 2011 Standard and a new dedicated virtual Backup Server (created on the same ESXi host to perform backup jobs with hotadd mode) running the Microsoft Windows Server 2008 R2 Standard Edition OEM license which came with the HP ProLiant ML370 G6 Server.

    I know that Windows SBS 2011 Standard is the last version in the Windows SBS line but I reckon it is still a perfect fit for many SME customers (especially in Italy) for the next two to three years. I also know that it could be purchased through all the usual channels (Retail, OEM, VL) until the end of June 2013 and that from June 2013 until the end of December 2013 it can be purchased through the OEM channel only.

    Questions:

    1) Would it possible to sell a Windows SBS 2011 Standard OEM license along with the above mentioned additional hardware components (plenty of HP memory, a 512MB with BBWC upgrade to the existing HP Smart Array P410i/256 MB Controller and an additional set of HP 6G SAS 15K rpm high performance drives) and tie it to the existing HP ProLiant ML370 G6 Server without breaking Microsoft Licensing ?

    2) Would it be possible to provision a VMware virtual machine and run a virtual Microsoft Windows Server 2008 R2 Standard Edition operating system environment from the OEM license which came with the HP ProLiant ML370 G6 Server without breaking Microsoft Licensing ?

    I have been told in the past that OEM licenses are available with any hardware (mouse, keyboard, case screw*...) and MS are not too fussed about what as it sells licenses

    As far as virtualisation goes, again I don't think there are any issues - of course if you move the virtualisation host in the future, that could be breaking the EULA.

    Basically, I suspect that as long as you have attempted to comply with the spirit of the licensing, you will be OK - there is little actual checking of license compliance so if you can show correct numbers of OS/CALs, why would there be a problem?

      thank you for your reply.

      I was aware in the past that OEM licenses were available with non-peripheral hardware in order to stay compliant with Microsoft Licensing, so in our scenario there should be no issues at all since we will be selling additional server hardware components (HP memory upgrade, a 512MB with BBWC upgrade to the existing HP Smart Array P410i/256 MB Controller and an additional set of HP SAS drives).

      I guess the availability of OEM operating systems licenses with non-peripheral hardware still applies today ?
